Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Babelphish mobile applications and related services (collectively, the “Services”), operated by MRF Technologies, LLC (“Company,” “we,” “us,” or “our”). By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By accessing or using the Services, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them and our Privacy Policy.

2. Description of Services

Babelphish develops agentic native mobile applications. Meal Tracker is a meal and nutrition tracking application that uses artificial intelligence to parse natural language meal descriptions and estimate nutritional information including calories, protein, carbohydrates, fat, and fiber. Nutritional estimates are generated server-side using an AI model.

3. User Accounts

Access to certain features requires creating an account. You agree to:

• Provide accurate and current information during registration
• Maintain the confidentiality of your account credentials
• Notify us promptly of any unauthorized access to your account
• Accept responsibility for all activity occurring under your account

Authentication is handled through Auth0’s secure identity platform. We do not store your passwords.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or extract source code from any part of the Services
• Transmit any content that is harmful, offensive, or infringes third-party rights
• Use automated means to access the Services without our prior written consent

5. AI-Generated Content

Meal Tracker uses an AI model to estimate nutritional information from meal descriptions. You acknowledge and agree that:

• AI-generated nutritional estimates are approximations and may not be accurate
• The Services are not a substitute for medical, dietary, or nutritional advice from a qualified professional
• You bear sole responsibility for decisions made based on AI-generated estimates
• We are not liable for any health outcomes resulting from reliance on these estimates

6. Intellectual Property

The Services — including all software, designs, text, graphics, trademarks, and other content — are owned by MRF Technologies, LLC or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Services beyond the limited license to use them as expressly provided here.

7. Privacy

Your use of the Services is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described therein.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT NUTRITIONAL INFORMATION PROVIDED BY AI WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MRF TECHNOLOGIES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY HEALTH-RELATED OUTCOMES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless MRF Technologies, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Effective Date” at the top of this page. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, for any reason, with or without notice. You may also request deletion of your account at any time using our Account Deletion Form or through the in-app deletion option at Settings › Account › Delete Account. Upon termination, all rights granted to you under these Terms will immediately cease. Sections 6, 8, 9, and 10 survive termination.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which MRF Technologies, LLC is organized, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of competent jurisdiction in that state.
